Original Beta Cardholder waiver

$0 Kit Membership Fee for lifetime of your current membership
Kit customers (Kit Card and Kit Account holders) that were in the original group of Beta testers before 28th February 2023, will not pay a Kit membership fee (for their Kit Card and Kit Account) for any of the children on their app for the lifetime of their current membership.

Terms and Conditions and Eligibility Criteria
Kit membership fees apply to use of the Kit Card and Kit Account from 1st November 2023. However, for customers of Kit (those who hold an active Kit Card and Kit Account) who have met the eligibility criteria and subject to the terms and conditions below, Kit will automatically waive Kit membership fees for the lifetime of your current Kit membership.
You must satisfy the following conditions to be eligible for this waiver:
You are aged 18 or above and are an Australian resident;
Your Kit Account and first child profile was successfully created before 28th February 2023.
You have maintained your Kit membership (holding a valid Kit Card and Kit Account) since opening the account, which occurred prior to the 28th February 2023.
You currently hold a Kit Card and Kit Account that has not been cancelled by you or Kit (including by Hay Limited as the Kit Account product issuer).
You have reviewed and agreed to comply with any of our eligibility criteria and terms and conditions that are made available to you during the Kit app download process and Kit account opening process. These terms and conditions set out details on the Kit membership fees amongst other important information, and include the Kit Product Terms and Conditions, Product Disclosure Statement and other terms and conditions set out at www.heykit.com.au/legal
To remain eligible for the lifetime waiver, you will need to keep your Kit Card and Account open with at least one active child. If you close your Kit Account and return later, your new Kit Account will not be eligible for the fee waiver and the then-current Kit membership fees will apply. Terms for waiver:
If you meet the eligibility criteria above, Kit will automatically waive your Kit membership fee for 6 months, from November 2023 to April 2024.
Kit will default you to the monthly Kit membership option from April 2024, and adjust the monthly fee charge to the number of children you have successfully profiled in the Kit app. Fee details can be found in the Kit Card and Account Terms and Conditions and the Product Disclosure Statement found here www.heykit.com.au/legal
Your first fee charge date will be your anniversary date (which is the date your first child’s profile was successfully created for the Kit Card and Kit Account in the Kit app). Kit will remind you of this fee payment and anniversary date 30 days before your first fee is charged.
You will be able to manage your membership fee type in the Kit app.
You can always cancel your membership in the Kit App by closing your Kit Account, following the cancellation process set out in the Kit Card and Account terms and conditions. If you cancel your membership you will no longer be eligible for the any remaining period of the 6-month Kit membership fee waiver if you rejoin.

COMPETITION INTRODUCTION
1. The competition name is the Kit Money Chats Competition (“the Competition”).
2. The promoter is CBA New Digital Businesses Pty Ltd ABN 38 633 072 830, trading as Hey Kit (the “Promoter”). CBA New Digital Businesses Pty Ltd is a subsidiary of the Commonwealth Bank of Australia ABN 48 123 123 124 (“CBA”).
3. The Competition commences at 9.00AM (AEST time) on 5 April 2023 and closes at 11.59PM (AEST time) on 26 April 2023 (“Competition Period”).
COMPETITION PRIZE
4. The prize (“Prize”) for the Competition is three (3) $150 eGift cards valued at $150 AUD each (i.e. a total of $450 AUD in eGift vouchers). The total value of all Prizes is $450 AUD.
5. The total number of Prizes for the Competition is three (3) prizes each consisting of one (1) voucher with details stated in section 4, and each of these Prizes will be randomly drawn.
6. The Prize:
a. Will expire in 3 years from the acceptance date, and any balance remaining on that date will not be available for use or otherwise be replaced by the Promoter;
b. The vouchers will need to be activated within 3 months from the acceptance date.
ELIGIBILITY
7. Entry into the Competition is open to Australian residents who at the time of entry:
a. Are over the age of 18;
b. Be an Australian resident.
c. Are not an employee or an immediate family member (spouse, parent, sibling or child) of an employee of the Promoter or of the Promoter's related entities directly involved in the Promotion (as determined by the Promoter),
("Eligible Participants").
HOW TO ENTER
8. Eligible Participants must enter the competition by 26 April 2023 at 11:59PM (AEST time), including by:
a. Commenting on one (1) of four Instagram of Facebook posts and tagging a friend in the comments for one (1) entry.
b. For additional entries, repost any of the four conversation prompt posts to their social channels using the hashtag #MoneyKitChat. Note participants can earn up to four (4) additional entries here by sharing each of the posts one (1) time.
c. For another additional entry, participants can record a response to the question in the post and post their original content to their social channels including the hashtag #MoneyKitChat. Participants must include the #MoneyKitChat hashtag for this entry to count.
9. Three (3) Eligible Participants will be selected electronically at random to win the Prizes ("Winner"), utilising a random prize draw system. The random prize draw will take place at 4:00PM (AEST) on 27 April 2023 ("Draw"). If you would like to view the draw, please contact us in accordance with clause 30 .
10. At the time of the Draw, the Promoter will randomly select an additional three (3) Eligible Participants to be reserve winners if the Winners do not claim the Prize in accordance with these Terms and Conditions ("Reserve Winners").
ANNOUNCING THE WINNER
11. The Winner will be notified within 2 business days of the draw via the direct messaging service on Facebook or Instagram. The Winner will also be announced via public posts on Kit Facebook and Instagram pages. The direct message will provide instructions on how the Winner may claim the Prize.
CLAIMING THE PRIZE
12. The Winner must claim their Prize by 4:00PM (AEST) on 26 July 2023 after the Prize has been awarded to them by confirming receipt of the direct message by responding to the message and providing a valid email address.
13. If the Winner does not claim their Prize in that time:
a. The Winner will be taken to have forfeited the Prize and the Promoter will instead award the Prize to the Reserve Winner to have been next drawn;
b. The Promoter will notify the Reserve Winner the direct messaging service on Facebook or Instagram within 2 business days of the Prize being awarded to them; and
c. The Reserve Winner must claim their Prize within 10 business days of being notified pursuant to clause 13(b).
14. If a Reserve Winner does not claim the Prize within 10 business days, the process set out in clause 13 shall be applied again, and so on until the Prize has been claimed.
15. The Winner or Reserve Winner will receive the Prize in digital format and it will be sent via email.
16. As a condition of claiming the Prize, the Winner or Reserve Winner (as the case may be) (Prize Recipient), must:
a. Accept these terms;
b. Consent to the publication of their name in accordance with these terms (or contact the Promoter if consent is withheld);
c. Consent to the Promoter using the Prize Recipient's name in any media for an unlimited period without remuneration for the purpose of this Promotion (including any outcome); and
d. Sign any legal release and indemnity as may be reasonably required by the Promoter and/or any suppliers of any elements of the Prize.
GENERAL
17. Information on how to enter and prize details set out in all communications regarding the Promotion forms part of these terms.
18. Should they be a Winner, Entrants consent to publication of their name and address in accordance with these terms.
19. Any entry not complying with these terms is invalid. Errors and omissions may be accepted at the Promoter's discretion.
20. Any complaints regarding the Promotion may be submitted to the email set out in clause 30 below in these terms. If there is a dispute concerning the complaint, the decision of the Promoter is final and binding and no further correspondence will be entered into unless we agree otherwise (acting reasonably).
21. Beneficiaries of the Prize accept the Prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from their Prize. Beneficiaries of the Prize should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.
22. Promoter reserves the right, at any time, in its sole discretion, to verify the validity of entries and Entrants (including an Entrant’s identity, age, and place of residence) and reserves the right, in its sole discretion, to disqualify any Entrant whom the Promoter has reason to believe has breached any of these terms, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
23. If for any reason this Promotion is not capable of running as planned (including, but not limited to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may, subject to the approval of all relevant regulatory authorities, take any action that may be available including cancelling, terminating, modifying or suspending the Promotion.
24. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
25. Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the states and territories of Australia (Non-Excludable Guarantees).
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related entities (including its respective directors, officers, employees and agents) are not responsible for and exclude all liability, for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (that are not wholly under the Promoter’s control); (b) any theft, unauthorised access or third party interference (by a third party not wholly under the Promoter’s control); (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value not within the Promoter’s reasonable control to that stated in these terms; (e) any tax liability incurred by a beneficiary of a Prize (including an Entrant and the Prize Recipient); (f) use/taking of the Prize (g) the Promotion.
27. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of interest to you.
28. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions.
29. The Promoter will use and handle your personal information as set out in its Privacy Policy, which can be viewed at https://www.heykit.com.au/. The Privacy Policy set outs how you may access, update or correct your personal information, change your direct marketing preferences or make a privacy complaint.
30. You may contact the Promoter via support@heykit.com.au.
31. The Promoter promotes this trade promotion on its own behalf, and not on behalf of its parent company Commonwealth Bank of Australia (CBA) or its other Related Bodies Corporate (as that term is defined in the Australian Corporation Act). Any entrant’s or Winner’s rights under this trade promotion are enforceable only against Promoter, and Promoter’s obligations are owned only by the Promoter. Notwithstanding any other terms of this trade promotion to the contrary:(i) nothing in this Agreement binds CBA or its other Related Bodies Corporate in contract or otherwise; and (ii) the Promoter is not an agent or otherwise authorised to make representations on behalf of CBA or its other Related Bodies Corporate.

$15 will be credited into the Kit Account for the first child profile created by each user who has satisfied the eligibility terms directly below. A maximum of $15 will be credited per household. $15 will be credited to the applicable Kit Account by 14 December 2022 (and no further claiming is required by the user). Eligibility terms
Promotion commences 12.01AM AEST, 1 November 2022. If you are entering this promotion, you must satisfy the following conditions in order to be eligible, and before the promotion closing time of 11.59PM AEST, 30 November 2022:

COMPETITION INTRODUCTION
1. The competition name is the Kit Account Competition (“the Competition”).

b. Sign up and unlock Beta access using the same email used to sign up to the Kit waitlist.
c. Create a Kit account, including linking a Parent bank account and ordering a physical card for your child.
d. Eligible Participants are only eligible to enter the Competition once.
9. Five (5) Eligible Participants will be selected at random to win the Prizes ("Winner"), utilising a random prize draw system. The random prize draw will take place at 10:00AM (AEST) on 17 August 2022 ("Draw"). If you would like to view the draw, please contact us in accordance with section 21.
10. At the time of the Draw, the Promoter will randomly select an additional five (5) Eligible Participants to be reserve winners if the Winners do not claim the Prize in accordance with these Terms and Conditions ("Reserve Winners").
ANNOUNCING THE WINNER
11. The Winner will be notified within 2 business days of the draw by email and using the email address provided by the Winner in the Kit Beta sign up form. The email notification will provide instructions on how the Winner may claim the Prize.

12. The Winner must claim their Prize by 5:00PM (AEST) on 30 August 2022 after the Prize has been awarded to them by confirming receipt of the email notification by return email or by such other method specified in the email notification.
13. If the Winner does not claim their Prize in that time:
a. The Winner will be taken to have forfeited the Prize and the Promoter will instead award the Prize to the Reserve Winner to have been next drawn;
b. The Promoter will notify the Reserve Winner by email to the email address provided by the Reserve Winner in the Kit Beta sign up form within 2 business days of the Prize being awarded to them; and
c. The Reserve Winner must claim their Prize within 10 business days of being notified pursuant to clause 13(b).
14. If a Reserve Winner does not claim the Prize within 10 business days, the process set out in clause 13 shall be applied again, and so on until the Prize has been claimed.
15. The Winner or Reserve Winner will receive the Prize in digital format and it will be sent via email.

21. The Promoter adheres to and will use and handle Eligible Participants’ personal information as set out in our Privacy Policy, which can be found on our website heykit.com.au. Eligible Participants may contact the Promoter via email at support@heykit.com.au.
22. Complaints regarding the Competition may be submitted by email to support@heykit.com.au. If there is a dispute concerning the complaint, the decision of the Promoter is final and binding and no further correspondence will be entered into.
23. To the extent permitted by law, the Promoter and its related entities and its and their respective directors, officers, employees and agents, will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to) indirect or consequential, financial or other loss to or by the Eligible Participants. The Promoter reserves the right in its sole discretion to disqualify a Winner or Reserve Winner who subsequently becomes ineligible or does not meet with the Eligibility requirements.
24. Terms or conditions prohibited by law shall be void without prejudice to the remaining terms.
